24/09/13. Aidan Ellis reviews 'Personal Injury Limitation Law 3rd Edition' by Frank Burton QC & Andrew Roy, and 'Limitation of Actions in England and Wales' by Martin Canny. Limitation is a terrifying issue for lawyers. Not because of the volume of case law surrounding the less than straightforward provisions of the Limitation Act 1980. Rather, in the world of personal injury, there are not many cold, hard barriers that can stop a claim in its tracks in the way that a properly pleaded limitation defence can. Moreover, where a claimant falls foul of limitation provisions, a claim for professional negligence is often not far behind. It is therefore not hard to imagine the demand for clear and comprehensive text books about limitation. Fortunately Bloomsbury offer two to chose from...
